Class Action Lawsuit Filed Today in the Circuit Court of Henry County

On Thursday January 30th, Humphrey, Farrington & McClain along with three Clinton, Missouri law firms filed a comprehensive class action lawsuit today in the Circuit Court of Henry County.  Earlier this week, lead trial counsel Ken McClain discussed this contamination, and indicated the firm’s intent to act quickly to assist affected citizens.  Today’s lawsuit represents the beginning of that work. The lawsuit asserts claims for property damage and medical monitoring for adults and children who have been exposed to the fly ash and Coal Combustion Residuals (CCR) created by activities at the Evergy Montrose Generating Station.  

The suit named Evergy Metro, Inc, Sutton Trucking, Inc., Kansas City Fly Ash, LLC, and Kissick Construction as defendants.  The petition details the conduct and practices leading to the alleged contamination, including decades of storage, maintenance and transport of hazardous fly ash in various ways.  The petition alleges, “. . . Defendants have not only caused economic damage to property owners but are also increasing the risk of disease to all members of the community exposed to Defendants’ CCR, including latent diseases that require medical monitoring for early detection.”

Attorney Andy Smith added, “We are also representing folks who believe they or their children are already sick.  These claims will be investigated and pursued individually for each sick person.  We know that class actions work well for property damage claims and future medical monitoring claims, but we want to be sure everyone who has been affected can be involved, especially if they have already suffered illness as a result.”
